Q: Will Medical Advocates provide me with an attorney?

A: Medical Advocates can help you find an attorney willing and able to represent you, but, we cannot guarantee that you will find an attorney willing to take your case. While whether or not a physician will support your case is one of the most important questions an attorney needs answered before taking a case, it is not the only one. There may be other factors present in your situation that deter attorneys from agreeing to represent you.

Q: How does obtaining a Medical Records Review help me?

A: Having your records reviewed by an independent, qualified physician provides you with objective, reliable information regarding medical care that has been provided to you.  You will learn whether or not your treating physician provided appropriate care or was negligent.  If the records reflect negligence, you are in a stronger position to retain an attorney because you now have received an objective, professional opinion that you have a case.

Q: Why would I want to retain my own medical expert?

A: Retaining your own medical expert eliminates many of the initial problems faced by counsel in deciding to take a case. Chiefly, it establishes by way of an objective, professional opinion that malpractice occurred. It also eliminates the need for the attorney to locate a medical expert willing to testify on you behalf and, finally, it reassures the attorney that you are well organized and committed to your case. Dealing with these issues on your own makes your case very attractive to potential attorneys.

Q: So why would I want to obtain a Medical Records Review?

A: Keep in mind that the goal of both Expert Retention and the Medical Records Review is to obtain an experienced medical malpractice attorney willing to represent you. If you cannot afford to retain a medical expert to examine your records, then a Medical Records Review offers the next best alternative. Also, some attorneys are willing to take your case contingent upon a positive Medical Records Review and, thus, you may wish to simply pay for the Review as a prelude to working with this attorney.
